FRUIT Website Terms of Use
1. About these Terms
These Terms apply to your use of byfruit.io and FRUIT website pages that link to them. The website is operated by FRUIT Holdings, Inc., a Wyoming corporation with its primary operating location in Florida, United States (“FRUIT,” “we,” “us”).
Please read these Terms before using the website. By using the website after these Terms are made available to you, you agree to them to the extent an enforceable agreement is formed under applicable law. If you do not agree, do not use the website. Any future interactive evaluation may require separate affirmative acceptance.
Our Privacy Policy explains personal information handling. Our Cookie Policy explains cookies and preferences. Reading or accepting these Terms does not constitute consent to optional analytics.
2. Website purpose and technical information
The website provides company, editorial, educational, research, technical and commercial inquiry information. Statements about PAVE or another technology describe only the scope and version identified with the material. Research, examples, diagrams and demonstrations may be incomplete, experimental or revised. A roadmap is not a commitment to provide a feature, integration, release or service.
The website does not provide professional advice, decision authority or a substitute for your independent assessment. Do not rely on an evaluation or illustrative output for production, safety-critical, legal, financial, medical, employment or other consequential decisions.
3. FRUIT materials and reserved rights
FRUIT or its licensors retain their rights in website content, PAVE technology, source code, schemas, APIs, research, designs, technical documentation, demonstrations, inventions, trademarks and other intellectual property, subject to applicable law and any expressly identified third-party rights.
You may access and read publicly available pages through their intended interfaces and make ordinary transient copies needed to browse them. You may link to a public page without suggesting affiliation or endorsement. This permission does not authorize implementation, reproduction for redistribution, adaptation, commercialization, sublicensing or exploitation of FRUIT technology.
Except for that limited website-use permission, a separately identified license, or rights you have under applicable law, no license is granted by publication, disclosure, access, implication, estoppel or otherwise under any copyright, patent, patent application, trade secret, trademark or other FRUIT right. In particular, public access to PAVE documentation, schemas, source excerpts, APIs or demonstrations does not grant rights to build, operate, reproduce or commercially exploit PAVE.
If a particular file or repository expressly includes a license, that license governs the material it covers. These Terms do not withdraw rights already granted under it. A link to GitHub, Hugging Face or another service does not itself establish that PAVE is open source.
A patent or patent-pending label applies only where separately stated for the identified material and verified by FRUIT. No statement here represents that a patent has been granted, that every feature is patented, or that a pending application will issue. Licensing inquiries: licensing@byfruit.io.
4. Permitted use and restrictions
Use the website lawfully and through its intended interfaces. Do not interfere with its operation; bypass access controls, authentication or technical restrictions; introduce malicious code; impersonate another person; obtain data or nonpublic materials without authorization; remove ownership notices; or use the website to infringe rights or harm others.
Do not use automated requests that evade restrictions or materially burden the service. Do not misrepresent a demonstration, test result or FRUIT relationship. Nothing here restricts activities that applicable law permits notwithstanding a contractual restriction.
5. Demonstrations and other terms
Any future interactive PAVE evaluation will require the separately approved terms presented for that experience. Future developer, API or MCP access requires the separately approved terms and scope presented for that access. Merely reading developer information does not create an account, entitlement, credential or service commitment.
An expressly executed commercial license governs the rights it grants. For a conflict, that agreement governs its subject matter; accepted experience-specific terms govern that experience; these Website Terms govern general website use. A privacy notice is a description of data handling, not a commercial license.
6. Inquiries, submissions and confidentiality
Provide only information you are entitled to share and that is reasonably necessary for your inquiry. Do not send passwords, API keys, credentials, sensitive personal information, confidential business information or unpublished inventions through public forms or ordinary inquiry email unless FRUIT has expressly arranged an appropriate channel and applicable agreement.
An inquiry alone does not create a confidentiality agreement, attorney-client relationship, partnership, agency, exclusivity, license, obligation to negotiate or obligation to enter a transaction. An existing written confidentiality agreement continues to govern information within its scope.
You retain your rights in your inquiry. You authorize FRUIT to receive, store, review and use it as reasonably necessary to respond and administer the inquiry, subject to our Privacy Policy and applicable agreements. We do not obtain ownership of your materials merely because you contact us.
7. Feedback
You may voluntarily provide nonconfidential suggestions about the website or an evaluation. FRUIT may consider and use general suggestions without an obligation to implement them or pay compensation. This clause does not transfer ownership of submitted inventions or grant a license to your protected technology. If a suggestion requires a separate license or confidentiality arrangement, agree that arrangement before submitting it.
8. Trademarks and third-party materials
FRUIT and PAVE names, logos and other marks may not be used to imply sponsorship, endorsement or affiliation without permission. References to third-party marks identify their respective owners and do not establish a partnership. Lawful descriptive uses remain available.
Third-party links, repositories, media and services are governed by their own terms and privacy practices. FRUIT does not control them or guarantee their availability or content. Separate licenses and attribution notices accompanying third-party materials remain applicable.
9. Availability and disclaimers
We may correct, update, remove or restrict website materials or access, including for maintenance, security, legal requirements or misuse. We do not promise continuous availability, support or preservation of an evaluation state.
To the fullest extent permitted by law, the website and its informational materials are provided “as is” and “as available,” without warranties of accuracy, completeness, fitness for a particular purpose, merchantability or noninfringement. Nothing excludes a warranty or responsibility that applicable law makes non-excludable, or alters an express obligation in a separate signed agreement.
10. Limitation of liability
To the extent permitted by applicable law, FRUIT will not be liable for indirect, incidental, special or consequential losses, or lost profits, business opportunities or data, arising from use of this informational website.
No exclusion applies to fraud, intentional misconduct, or any liability that cannot lawfully be excluded or limited. Mandatory consumer rights remain unaffected.
11. Updates and general provisions
We may revise these Terms by posting a dated version. Material changes will be identified through an appropriate website notice; any change requiring renewed agreement will be presented for acceptance. Changes apply prospectively and do not retroactively expand rights in earlier submissions.
If a provision is unenforceable, the remainder applies to the extent lawful. Failure to enforce a provision is not a waiver. Restrictions and rights that by their nature should continue after use ends, including ownership and lawful liability provisions, survive.
